FOX 29 Kwik Fill Racing Challenge – UPICKEM LOCAL RULES
General
UPICKEM is an online game being sponsored and promoted by The Douglas Group, Inc. dba UPICKEM (hereafter, “UPICKEM”) and a number of television stations located in different cities (please review UPICKEM’s official rules). In addition to the national game conducted by UPICKEM, television broadcast station WUTV will have a single winner from all participants in the Buffalo DMA and a single grand prize winner within the Buffalo DMA.
Who Can Enter
1. To be eligible to participate in this contest, entrants must be U.S. residents, who are 18 years of age or older, and reside in the Buffalo viewing area (the DMA).
2. Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Television of Buffalo, Inc., and any other company which owns, programs or provides other services to television broadcast stations WUTV and WNYO (the “Company”), The Douglas Group, Inc., Kwik Fill, Just Pizza their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.
How to Enter / How to Win
(a) No purchase is necessary to enter. Only one entry accepted per person. An entrant who is otherwise a winner may be disqualified if they are found to have entered the contest more than once under separate e-mail accounts.
(b) The contest starts on Monday, April 13, 2009 at 12:00 p.m. ET, and at 12:00 p.m. ET on Sunday, April 19, 2009 (the “Contest Period”).
(c) To enter, log onto WUTV.com and click on the “UPICKEM” icon. Register for this contest by entering your name, address, phone number, and birth date, together with responses to any informational questions included in the registration process. Registered entrants will need to log on to predict the top 10 finishers of certain NASCAR Races. The predictions for each race may be made beginning the Monday prior to the race up until fifteen (15) minutes prior to the beginning of televised race coverage of each NASCAR race during the Contest Period. No mechanically completed entries will be accepted.
(d) Following each NASCAR race during the Contest Period, entrants will receive a pre-determined number of points each correct prediction. All entrants will be treated as having correctly predicted the winner of races ending in a tie. Points will be awarded for the local prize for each race. In the event an entrant does not participate one week, their predictions will carry over to the next race and will be automatically entered to win a local prize.
(e) Following each race, the entrant with the highest points for that race will receive a prize. In the event of a tie, one winner will be randomly selected from among the tied entrants. No entrant may win a local contest as a result of points received by being automatically credited with points from the following race. If a participant wins more than one week, they are not eligible to win a second weekly prize and the prize will not be awarded that week.
(f) The Company is not responsible for lost, late, misdirected entries (including predictions), printing errors, software failure, server unavailability, computer or any other electronic malfunction. All entries received that are tampered with, illegible, or from ineligible entrants will be void. Entrants may not enter using multiple e-mail addresses or as multiple entrants. Any entrant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. All entries become the property of the Company and will not be acknowledged or returned.
(h) In the event a participant in the contest disputes the points that such participants receives for any week of the contest, that participant must notify the Company in writing of such dispute within five (5) days of the Company declaring the results for such week. The failure to notify the Company within such five (5) day period shall constitute the agreement of the participant that the determination of participant’s points by The Company is accurate and participant shall be deemed to have the number of points determined by the Company even if such determination was in error. Notifications to the Company may be done by clicking on the support tab and then clicking on contact us.
(i) The Company reserves the right, in its sole discretion, to cancel or suspend the contest should virus, bugs, unauthorized human intervention, or other causes beyond the control of The Company, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the contest or for any other reason at the sole discretion of The Company.
The Prize (s)
1. Local winners will each receive One Large Pizza with one topping, once a month for 12 months. Each local prize is valued at $180.
2. Winners will be notified by email on the following Wednesday during the Contest Period. Within (2) two days of notification, winners must claim their prize in person at WUTV/WNYO, 699 Hertel Ave., Suite 100, Buffalo, NY 14207. Before receiving prizes, winners must provide their correct name, address, telephone number, and social security number to the Company at the time of notification. Before receiving prizes, winners must also sign and return a release and affidavit of eligibility, which will be emailed to the winner after claiming the prize on the website and which must be received by The Company with fourteen (14) day notification.
3. If a winner is not eligible to be the winner, or does not timely complete and return the release and affidavit of eligibility, or does not claim the prize within (2) two days of notification, then the prize may be awarded to the entrant with the next highest score. The Company reserves the right to extend the time period by which the winner must take necessary action to claim the prize.
4. There will be no substitutions or cash alternatives for prizes except at the sole discretion of The Company. The Company has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
5. The winners are responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules.
6. Only one weekly prize will be awarded per household. A weekly prize winner is eligible to be the grand prize winner. If a participant wins more than one week, they are not eligible to win a second weekly prize and the prize will not be awarded that week.
7. The Company and sponsors shall not be liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
8. The Company and sponsors are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.
9. In claiming a prize, winner must acknowledge that The Company has the right to publicize winner’s name, character, likeness, photograph, and voice for promotional purposes without financial remuneration.
10. The Company shall not be responsible for the failure of any winner to claim a prize as a result of such winner’s failure to receive an e-mail from The Company regardless of the reason for such failure.
Odds of Winning / Miscellaneous
1. Odds of winning depend on the number of correct entries received.
2. Prize winners will be listed on the contest website. Official rules are available online at wutv.com.
3. This contest is subject to all applicable laws and regulations and is void where prohibited. The Company and any local sponsors accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
4. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of The Company or any sponsor, shall be governed by and construed in accordance with laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules or provisions (whether Maryland or any other jurisdiction) that would cause the application of the laws of any other jurisdiction other than Maryland. The invalidity of unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as of the invalid or unenforceable provision was not contained therein. All claims relating to the contest must be brought in the federal or state courts located in Baltimore County, Maryland, which shall have the exclusive jurisdiction and venue over such claims.
5. The Company cannot be held liable for any lost or stolen entries, prizes or contest information.
6. The Company reserves the right to make rules and contest changes and change the aforementioned contest dates at any time and in its sole discretion.

You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.

UPICKEM and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.
Affiliates reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to UPICKEM and its affiliates the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
UPICKEM and its affiliates reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and its affiliates are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
If a race is canceled, forfeited, or indefinitely suspended for any reason that race shall not count for any contestant and scores will be computed as if the race did not exist.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
For each race, players will pick the 10 drivers they think will finish 1st through 10th. Drivers will be awarded Fantasy Points depending on how they finish. 1st place is worth 150, 2nd place is worth 125, 3rd place is worth 100, 4th place is worth 80, 5th place is worth 78, and so on (less 2 points each place). 44th place and beyond are worth 0 points. The total Fantasy Points for all the player's drivers in the race becomes the Team Score. There is an additional 25 point bonus for every driver that comes in the exact order the player picks them to finish.
You total score is the sum of your 15 best races.
If there is a tie for the most points for a race, the tie breaker is handled by first seeing who picked the most drivers in the right order. If there is still a tie, the computer will see who picked the highest place correct. If there is still a tie, the computer will randomly select a winner from the players that are tied.
If there are ties for overall score, the computer will select the player with the most race points for the most recent race. If there is a tie, the computer will continue comparing race points for previous races until a winner is selected. If the players are tied for all the races, the computer wil randomly select a winner from the players that are tied.
Points are awarded to drivers, not cars. If a player picks a driver who qualified for race and a new driver took his/her place before the start of the race, the player must pick the new driver. Players will not receive points even though the new driver may be racing the previous driver's car. And, if the new driver is not in the list of drivers that can be picked then no players shall have the ability to pick that driver and it will not count for or against anyone.
Weekly winners are based on the race finish order immediately following the race. If the race finish order is adjusted after the race, the weekly winners will remain the same but all players' points will be recomputed for the season total.
All decisions of the judges are final.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
